Although many changes have been made in the bankruptcy laws in the Bankruptcy Reform Act of 2005, most people can still file for bankruptcy and get complete relief from their debts. Chapter 7 Bankruptcy - Eliminate Your Debts
A bankruptcy under Chapter 7 is usually called a liquidation bankruptcy and it is what most people think of when they think of bankruptcy. You can eliminate almost all of your debts under Chapter 7, including credit cards, judgments, medical bills and unsecured loans. You can't get rid of taxes, student loans or child support obligations. For a quick checklist of what you can keep, look at the Exemptions Link under bankruptcy, I have highlighted the main things you can keep under the State or Federal exemptions. Most people are surprised that they can file bankruptcy, eliminate all their debts and keep everything they own. I will review everything with you before filing.
Chapter 13 Bankruptcy - Stop Foreclosure and Save Your House
One thing that you can't do in a Chapter 7 bankruptcy is make payment arrangements to catch up on mortgage arrears. Most people who decide to file for Chapter 13 do so to save their home from foreclosure. If a temporary set back caused you to fall far behind on your mortgage payments, a Chapter 13 Bankruptcy Plan may very well save your house and allow you three to five years to pay back the mortgage arrears and stop the foreclosure immediately. I have helped countless people put together a Chapter 13 bankruptcy that allowed them relief from debt and saved their home from foreclosure.

- Your last 2 Years of Tax Returns
- Deed / Declaration of Homestead
- Tax Assessors Statement of Value of House
- Recent Mortgage Statement

Creditors Meeting
The creditors meeting is a short meeting that is conducted by an attorney appointed to be a Bankruptcy Trustee by the Bankruptcy Court. I attend these meetings with all my clients. Although it is called a creditors meeting, creditors seldom actually show up. The Trustee just wants to review the bankruptcy petition to make sure it is accurate and correct. You will get a notice from the Bankruptcy court about when your meeting will be held. You can call me as well for information about the meeting, I usually will get the information before you. All you have to bring to the meeting is a photo ID, such as a driver's license and proof of your social security number, such as your social security card or a Passport. I send a copy of your tax returns, paystubs, and bank account information to the Trustee ahead of time. The Creditors meeting is NOT the Spanish Inquisition! Most of them take about 10 minutes, and the longest part of the meeting is the wait for your turn.
